2. SUBJECT OF THE ORDERED PRODUCTS

The subject of this agreement is to define the rights and obligations of the parties regarding the sale and delivery of the product specified below, ordered by the BUYER electronically from the SELLER’s website, www.mintco.co, in accordance with the provisions of Law No. 4077 on Consumer Protection and the Regulation on Distance Contracts.

The BUYER acknowledges and declares that they have been informed electronically by the SELLER about the SELLER’s name, title, full address, telephone, and other contact details, the main characteristics of the product subject to the sale, its price including taxes, payment methods, delivery conditions and costs, and the conditions for exercising the right of withdrawal and how to exercise it, as well as complaints and appeals, and they have confirmed this information electronically before placing an order.

3. SUBJECT OF THE AGREEMENT

3.1. This Distance Sales Agreement (hereinafter referred to as the “Agreement”) regulates the rights and obligations of the parties regarding the product ordered by the BUYER from the website www.mintco.co (hereinafter referred to as the “Website”), purchased with the characteristics specified on the Website, and the sale price specified therein.

3.2. This Agreement is subject to the provisions of the Turkish Commercial Code (Law No. 6102) and the General Provisions of the Code of Obligations (Law No. 6098) as the parties are considered traders or because the Agreement is deemed a “commercial transaction.” The provisions of the Consumer Protection Law No. 6502 and related secondary legislation do not apply to this Agreement. Consequently, the BUYER cannot benefit from consumer rights such as the right of withdrawal granted under consumer protection laws.

3.3. The BUYER acknowledges and declares that they are aware of the main characteristics of the product subject to sale, its price, quantity, payment method, delivery conditions, and related information, as well as the terms of cancellation and return, and they have confirmed this information electronically and subsequently placed the order.

3.4. The preliminary information form and proforma invoice available on the payment page of the Website, as well as the Terms of Use and Privacy Policy, are integral parts of this Agreement.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The SELLER agrees and undertakes to fulfill the obligations imposed on them under the Law No. 4077 on Consumer Protection and the Regulation on Distance Contracts, except in cases of force majeure.

4.2. The SELLER is not responsible for price errors caused by system failures. Accordingly, the SELLER is not liable for any promotional, pricing, or system errors caused by unauthorized interventions or design issues on the Website. The BUYER cannot claim rights based on such errors.

4.3. Purchases can be made on www.mintco.co via credit card (Visa, MasterCard, etc.) or bank transfer. Orders for which payment is not made within one week of placement are canceled.

4.4. The BUYER agrees and undertakes to fulfill their obligations under the Agreement except in cases of force majeure.

4.5. By placing an order, the BUYER agrees to comply with the payment terms specified in the Agreement.

4.6. The BUYER acknowledges and declares that they have received all preliminary information about the product’s basic characteristics, price including taxes, payment and delivery conditions, and the right of withdrawal.

4.7. The SELLER reserves the right to change, cancel, or disable prices, products, promotions, and campaigns on the Website without prior notice.

5. DELIVERY OF PRODUCTS

5.1. Ordered products will be delivered to the address provided by the BUYER unless stated otherwise.

5.2. Delivery costs are covered by the SELLER.

5.3. Delivery of ready products is made within 2-4 business days.

5.4. Orders placed on weekends or public holidays will be processed on the next business day.

5.5. For international orders, all customs duties and extra costs are the BUYER’s responsibility.

6. RETURNS

6.1. The BUYER agrees to return the product in its original condition and packaging without any damage. Return shipping costs are borne by the BUYER.

6.2. Accessories cannot be returned or exchanged.

6.3. International returns are subject to customs fees and shipping costs, which are borne by the BUYER.

7. SELLER’S LIABILITY FOR DEFECTS

7.1. The BUYER must inspect the products upon delivery.

7.2. If any defect is found, the BUYER must notify the SELLER within 3 days.

7.3. Products must be returned in their original packaging with all accompanying documents.

8. FORCE MAJEURE

8.1. Events such as natural disasters, war, riots, legal changes, or strikes constitute force majeure.

8.2. The SELLER may cancel the transaction or delay delivery.

9. PRIVACY

The BUYER’s information will not be shared with third parties except as required by law.

10. APPLICABLE LAW AND JURISDICTION

10.1. Disputes will be resolved under Turkish law.

10.2. Istanbul Anatolian Courts and Enforcement Offices are authorized to resolve disputes.

By placing an order, the BUYER agrees to all terms of this Agreement.
